Parenting Plans and Child Support Orders

If nothing else, if you have children and you are going through a Divorce or Legal Separation, you should invest in a really good Parenting Plan and Child Support Order. Your Parenting Plan and Child Support Order should be customized with your family in mind. They should be centered on the bests interest of your children and that also help to provide you and your co-parent with helpful and practical co-parenting expectations and protocols.

Uncontested and Amicable Divorce or Legal Separation

If you and your spouse are in complete agreement with all aspects of your divorce or legal separation, you may be able to file an uncontested divorce. Even if you believe that you and your spouse are completely on the same page, however, you should still consult with an attorney to make that you have (1) covered everything, and (2) completed all of the forms correctly to make sure that the documents actually capture the agreement that you and your spouse have reached. Many people mistakenly believe that they and their spouse do not need to put the complete details of their agreement into writing. But, you might not actually understand your agreement the way that your spouse does, or your spouse might change their mind after the final papers are entered. Making sure that everything is properly put into writing will help you avoid disagreements and potentially devastating and expensive issues after your divorce/separation is final.

Contested Divorce or Legal Separation

When you and your spouse are not in agreement, maybe things are even getting nasty, it is important that you discuss your options, rights and how a mediator or the court might view your case with an attorney. Sometimes, you need an attorney to represent you throughout the entire process and to represent you to opposing counsel or to the Court. Sometimes, parties want to try to resolve things without attorneys, or they can’t afford a full-on attorney. But, you still need to talk to an attorney to make sure that you have considered all of your options and every issue. I offer full-representation on a client-by-client basis, but most of what I do is limited practice. I work with clients on what they need, allowing them to hire me for just what they need, or maybe just what they can afford.

Property Settlement Agreements and Separation Contracts

When you and your spouse have reached an agreement regarding how your assets and debts should be divided and how your real and personal property should be awarded, you need to document your complete agreement in a Property Settlement Agreement or Separation Contract. It is important that this document represents the complete agreement and leaves nothing out. It should also contain some key general legal provisions and warranties that will provide how you and your spouse will execute the agreement and that will protect you if the other party doesn’t fulfill their end of the bargain. Having an attorney draft this for you will save you from potential disputes and spending lots of money in legal fees down the road.

Pre-/Postnuptial and Cohabitation Agreements

There are many reasons why someone may want a prenuptial agreement before getting married, or a post-nuptial agreement to address or clarify financial matters after they have already said “I do.” Before you move in with a partner or significant other, entering into a Cohabitation Agreement can be helpful to establish equitable protocols and expectations when it comes to how you are going to handle finances and property after you move in together. I draft pre-/post-nuptial or cohabitation agreements specific to your goals for your relationship. I can also review and propose revisions to a pre-/post-nuptial or cohabitation agreement drafted by your partner’s attorney and advise you on your rights if your partner is requesting that you sign such an agreement.
